These Terms and Conditions set out the basis on which Rubbish Removal Catford provides waste collection and related services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions and Interpretation
In these Terms and Conditions, the following words shall have the meanings set out below:
Company means Rubbish Removal Catford, the waste collection service provider.
Customer means any person, business or organisation that requests or uses the services of the Company.
Services means any rubbish removal, waste collection, loading, transportation, disposal, recycling or related services provided by the Company.
Waste means any items, materials or substances the Customer asks the Company to remove, including household waste, commercial waste, bulky items and similar materials, except for items defined as prohibited or hazardous under these Terms and Conditions.
Booking means a confirmed request for Services made by the Customer and accepted by the Company.
Site means the property or location from which the Company collects the Waste.
2. Scope of Services
2.1 The Company provides waste collection and rubbish removal services within its designated service area, which includes Catford and surrounding locations, as advertised from time to time.
2.2 Services may include the loading of Waste, removal from the Site, transportation, and delivery of the Waste to an authorised transfer station, recycling facility or disposal site.
2.3 The Company will use reasonable care and skill in providing the Services, in accordance with applicable UK waste regulations and industry standards for rubbish removal.
2.4 The Company does not undertake demolition, structural alteration, plumbing, electrical work or any other specialist services unless explicitly agreed in writing.
3. Booking Process
3.1 Customers may request a quotation or place a booking by telephone, email or via any other booking method offered by the Company from time to time.
3.2 When requesting a quotation, the Customer must provide accurate information regarding the type, volume and approximate weight of the Waste, access to the Site, parking arrangements and any other relevant details which may affect the Services or pricing.
3.3 Any quotation provided by the Company is based on the information supplied by the Customer and is not binding if that information proves to be inaccurate or incomplete. The final price may be adjusted on-site following inspection of the Waste and assessment of the work required.
3.4 A Booking is only confirmed when the Company accepts the Customer’s request and provides confirmation, which may be given verbally, by email or via digital message. The Company reserves the right to refuse any Booking at its sole discretion.
3.5 By confirming a Booking, the Customer warrants that they are the owner of the Site or have the authority of the owner or occupier to arrange for rubbish removal and to grant the Company access to the Site for the purposes of performing the Services.
4. Access to the Site and Parking
4.1 The Customer must ensure that the Company has safe, unrestricted and suitable access to the Site at the agreed date and time of the Booking.
4.2 The Customer is responsible for securing any parking permits, permissions or exemptions required for the Company’s vehicles to park near the Site in order to carry out the Services.
4.3 Any parking fees, fines or penalties incurred solely as a result of the Customer’s failure to obtain appropriate permissions or give accurate access information may be added to the final invoice and payable by the Customer.
4.4 If the Company cannot safely access the Site or carry out the Services due to circumstances within the Customer’s control, the Company may treat the Booking as a late cancellation and apply a cancellation charge, as set out in these Terms and Conditions.
5. Customer Obligations
5.1 The Customer must ensure that all Waste intended for collection is clearly identified, accessible and not mixed with items that are excluded or hazardous, unless previously agreed with the Company.
5.2 The Customer must inform the Company in advance of any items which may require special handling, such as electrical equipment, mattresses, fridges or freezers, or materials subject to specific disposal regulations.
5.3 The Customer shall not request the Company to remove any items that are illegal to transport or dispose of, or that would cause the Company to breach any applicable legislation or permit conditions.
5.4 The Customer is responsible for supervising children, pets and third parties on the Site during the provision of the Services and must not obstruct or interfere with the Company’s staff or vehicles.
6. Prohibited and Restricted Waste
6.1 The Company does not normally collect hazardous or specialist waste, including but not limited to asbestos, chemicals, solvents, clinical or medical waste, pressurised containers, gas bottles, oils, fuels, explosives or any other materials classified as hazardous under UK law.
6.2 If hazardous or prohibited items are found within the Waste without prior disclosure, the Company may at its discretion:
a. Refuse to collect all or part of the Waste.
b. Charge additional fees for handling, segregation and lawful disposal.
c. Terminate the Booking and charge a reasonable call-out or cancellation fee.
6.3 The Customer shall be liable for any costs, fines, penalties or damages suffered by the Company as a result of the Customer including prohibited or hazardous items in the Waste without full disclosure and prior agreement.
7. Pricing and Payment Terms
7.1 Prices are generally based on the volume and type of Waste, the labour required, and any additional services provided, such as sorting or dismantling. Prices may also reflect access issues, loading times and any additional disposal charges imposed by waste facilities.
7.2 Unless expressly stated otherwise, all prices quoted are exclusive of any applicable taxes, charges or levies that may be imposed on the Services under UK law.
7.3 Payment is due in full on completion of the Services at the time of collection, unless alternative arrangements have been agreed in advance in writing.
7.4 The Company accepts payment methods as advised to the Customer at the time of Booking, which may include cash, card payment or bank transfer. The Company reserves the right to refuse cheques or other payment methods at its discretion.
7.5 For business customers with agreed credit terms, invoices are payable within the period set out on the invoice. The Company reserves the right to charge interest on overdue sums in accordance with applicable UK late payment legislation.
8. Cancellations and Amendments
8.1 The Customer may cancel or amend a Booking by contacting the Company as soon as reasonably possible.
8.2 If the Customer cancels a Booking more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless the Company has incurred specific costs in preparation for the Booking.
8.3 If the Customer cancels a Booking within 24 hours of the scheduled collection time, the Company reserves the right to charge a reasonable cancellation fee to cover lost time, travel, administrative costs or allocated vehicle and staff resources.
8.4 If the Customer is not present at the Site at the agreed time or fails to provide access, the Company may treat the Booking as cancelled and apply a call-out or cancellation charge.
8.5 The Company may cancel or reschedule a Booking at any time due to reasons beyond its reasonable control, including severe weather, vehicle breakdown, staff illness, accidents, legal restrictions or safety concerns. In such circumstances, the Company will seek to notify the Customer as soon as reasonably possible and arrange a new appointment. The Company will not be liable for any losses arising from such cancellation or rescheduling, except to refund any amounts paid in advance for Services not provided.
9. Performance of the Services
9.1 The Company will use reasonable efforts to attend the Site at the agreed time, but any times given for arrival or completion are estimates only and are not guaranteed.
9.2 If unforeseen circumstances arise on-site that significantly increase the volume of Waste, the labour required, or the complexity of the job, the Company may revise the price and seek the Customer’s agreement before proceeding.
9.3 The Company may, at its discretion, decline to remove items that it reasonably considers to be unsafe to handle or transport, or where removal would present an unacceptable risk of damage to property or injury.
10. Damage and Site Condition
10.1 The Company will take reasonable care when carrying out the Services to avoid causing damage to the Site. However, the Customer accepts that some minor scuffs, marks or disturbance may be unavoidable when removing bulky or heavy items, particularly in tight or restricted spaces.
10.2 The Customer must notify the Company in writing of any alleged damage to property within 48 hours of completion of the Services, providing reasonable details and evidence.
10.3 The Company’s liability for any damage shall be limited to the reasonable cost of repair or replacement of the damaged item, subject to the limitation of liability provisions set out in these Terms and Conditions.
11. Liability and Limitation
11.1 Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be excluded under applicable law.
11.2 Subject to clause 11.1, the Company shall not be liable to the Customer for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill arising out of or in connection with the Services.
11.3 Subject to clause 11.1, the Company’s total aggregate liability to the Customer for any loss or damage arising from any single event or series of connected events shall not exceed the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
11.4 The Customer shall indemnify and keep indemnified the Company against any claims, costs, damages or expenses arising from the Customer’s breach of these Terms and Conditions, including any failure to disclose hazardous or prohibited items within the Waste.
12. Compliance with Waste Regulations
12.1 The Company will handle, transport and dispose of Waste in accordance with applicable UK waste legislation, duty of care requirements and environmental regulations.
12.2 The Company uses licensed waste transfer stations, recycling centres and disposal facilities, and will take reasonable steps to ensure that materials are managed responsibly, with recycling and recovery prioritised where practical.
12.3 Where required, the Company will complete a waste transfer note or equivalent documentation describing the Waste and its origin. The Customer agrees to provide accurate information to enable the Company to complete such documentation.
12.4 Title to the Waste passes to the Company at the point of collection, except where prohibited items are discovered. In such cases, the Company may return the items to the Customer or require the Customer to arrange lawful disposal at their own expense.
13. Complaints and Dispute Resolution
13.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the matter with the Company as soon as reasonably possible, setting out the nature of the complaint and the outcome sought.
13.2 The Company will investigate complaints in a fair and timely manner and will endeavour to provide a response or proposed resolution within a reasonable period.
13.3 If a dispute cannot be resolved amicably, either party may pursue any remedies available under UK law. These Terms and Conditions do not affect any statutory rights that the Customer may have as a consumer.
14. Data Protection and Privacy
14.1 The Company may collect and process personal information about the Customer for the purposes of managing Bookings, providing the Services, processing payments and administering its business.
14.2 The Company will handle personal data in accordance with applicable UK data protection laws and shall take appropriate steps to protect such information against unauthorised access, loss or misuse.
14.3 The Customer consents to the Company using their contact details to communicate about current or future services, quotations and bookings. The Customer may request that such marketing communications cease at any time.
15. Variation of Terms
15.1 The Company reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of the Booking will normally apply to that Booking.
15.2 Any variation to these Terms and Conditions requested by the Customer shall only be effective if agreed in writing by an authorised representative of the Company.
16. Severability
16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, subject to any rights the Customer may have under consumer protection legislation to bring proceedings in other appropriate jurisdictions.
